Terms of Use

1. About these terms

These Terms of Use ("Terms") are an agreement between you and Geode Solutions Pty Ltd (ABN 48 167 312 398), an Australian company based in Queensland ("we", "us", "our"). They cover your use of kyuflow.

By creating an account or using kyuflow, you agree to these Terms. When you create an account, we record which version of these Terms you accepted. Our Privacy Statement and Cookie and Storage Notice explain how we handle personal information.

2. Who can use kyuflow

You must be at least 16 years old to use kyuflow. If you are under the age of majority where you live, you must have permission from a parent or guardian.

You are responsible for keeping your sign-in details secure and for activity on your account. Tell us promptly at info@gogeode.com if you think your account has been misused.

3. Health and safety

kyuflow is a training tool. It is not medical advice and does not replace a doctor, physiotherapist, dietitian, or other qualified professional. This applies to workouts, programs, recommendations, recovery and readiness information, and AI-generated content.

• Speak to a qualified health professional before starting a new exercise or nutrition program, especially if you have a medical condition, an injury, or are pregnant.
• Exercise involves a risk of injury. Train within your ability, use equipment safely, and stop if you feel pain, dizziness, or discomfort.
• If you think you are having a medical emergency, contact your local emergency services immediately.

4. Your content

You keep ownership of the workouts, programs, notes, measurements, and other content you add ("Your Content"). You give us a non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Content only as needed to provide kyuflow to you and to keep it secure. This license ends when Your Content is deleted from our live systems.

You are responsible for Your Content. Do not add content you do not have the right to use.

5. AI features

Some features use AI to interpret or generate training programs. AI output can be inaccurate, incomplete, or unsuitable for you. Review it before you rely on it, and apply section 3. You are responsible for how you use AI output.

6. Acceptable use

You must not:

• break the law, or infringe anyone's rights, through kyuflow;
• try to access accounts or data that are not yours, or test, scan, or bypass our security;
• interfere with or overload the service, or use automated means to access it except through features we provide;
• copy, resell, or reverse-engineer kyuflow, except where the law allows;
• upload malicious code, or content that is unlawful, harassing, or harmful.

7. Subscriptions and payments

Plans are Free, Plus, and Pro. Some features need a paid plan. Prices, inclusions, and billing periods are shown on our pricing page before you buy.

• Payments are processed by Stripe. Stripe's terms also apply to your payment.
• Recurring plans renew automatically at the end of each billing period until you cancel. You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then.
• Refunds. We do not refund partial billing periods, except where the law requires it or where we say otherwise in writing.
• Price changes apply from your next billing period. We will give you reasonable notice first, and you can cancel before the change takes effect.

8. Our intellectual property

kyuflow, including its software, design, content library, and branding, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use it under these Terms.

9. Third-party services

kyuflow can connect with services we do not control, such as Google sign-in, Apple Health, and Stripe. Your use of those services is governed by their own terms.

10. Changes, suspension, and termination

We improve kyuflow over time and may change or remove features. If a change materially reduces a paid feature you rely on, we will tell you in advance where practical.

We may suspend or close an account that seriously or repeatedly breaches these Terms, or where we must do so to comply with the law. Where appropriate, we will give you notice and a chance to fix the problem.

You can stop using kyuflow at any time, and you can ask us to delete your account by emailing info@gogeode.com.

11. Your consumer rights

Nothing in these Terms limits any right or remedy you have under consumer laws that cannot be excluded. This includes the consumer guarantees in the Australian Consumer Law, and the mandatory consumer protections of the country where you live, such as those in the EU and UK.

If you are an Australian consumer, our services come with guarantees that cannot be excluded under the Australian Consumer Law. Where the law allows us to limit our liability for failing to meet a guarantee, we limit it to supplying the services again or paying the cost of having them supplied again.

12. Disclaimers and limits on liability

To the extent the law allows, and subject to section 11:

• kyuflow is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free, or suitable for a particular fitness goal.
• We are not liable for indirect or consequential loss, or for loss of data, profits, or opportunity.
• Our total liability to you for any claim about kyuflow is limited to the amount you paid us in the 12 months before the claim arose, or AUD 100 if you have not paid us anything.

These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence where the law prevents limiting it, or for fraud.

13. Governing law and disputes

These Terms are governed by the laws of Queensland, Australia. If a dispute arises, contact us first at info@gogeode.com so we can try to resolve it informally.

If it is not resolved, the courts of Queensland, and courts that can hear appeals from them, can decide it. If you are a consumer, this clause does not take away your right to rely on the mandatory laws of the country where you live, or to bring proceedings in the courts there.

14. Changes to these Terms

We may update these Terms. The version and effective date are shown at the top of this page. If a change is material, we will ask signed-in members to accept the updated Terms in the app before they continue. If you do not agree, you can stop using kyuflow and cancel any subscription.
